Act Title XI
Transportation and Utility Systems Rights-of-Way
With the passage of the Alaska National Interests Lands Conservation
Act (ANILCA) on December 2, 1980, Congress addressed Alaska’s
largely undeveloped transportation and utility network in Title XI (Transportation
and Utility Systems In and Across, and Access Into, Conservation System
Units). In response to Alaska’s
anticipated future requirements for transportation and utility systems
and to minimize adverse impacts to conservation system units, such as
National Wildlife Refuges, Congress provided an orderly, continuous
decisionmaking process involving Federal and State governments and the
public.
Title XI rights-of-way are issued according to both the ANILCA and
the National Wildlife Refuge System Administration Act of 1966, as amended
by the National Wildlife Refuge System Improvement Act of 1997. These
rights-of-way are specifically used for transportation and utility systems
within conservation system units, including National Wildlife Refuge
System lands administered by the Fish and Wildlife Service.
Transportation and Utility Systems include but are
not limited to: canals, pipelines, electrical transmission and distribution
systems, radio and television systems, roads, landing strips, docks
and other systems of general transportation.
