The Federal Water Pollution Control Act and the Federal Oil Pollution
Prevention Regulations (40 CFR 112) require a written Spill Prevention
Control and Countermeasures (SPCC) Plan for each Service facility
where a spill could reasonably be expected to discharge oil into or
upon navigable waters of the United States. The facility must also
have a total underground storage capacity of more than 42,000 gallons;
have a total aboveground storage capacity of more than 1,320 gallons;
or, have a single aboveground container larger than 660 gallons.
All Refuges in Region 7 are required to have SPCC Plans. A professional
Engineer is required to conduct an on-site inspection of the facility
before certifying an SPCC Plan. Plans must cover spill prevention,
spill response, and training of response personnel. Deficiencies identified
in developing the Plan (e.g. inadequate lighting and fencing, lack
of secondary containment, incomplete training, missing records, etc.)
must be corrected to bring the facility into compliance. The Service
began implementing the SPCC program in FY 1998.
Federal facilities without a written SPCC Plan are in noncompliance
with environmental laws and regulations. They are subject to Notices
of Violation and fines. The Service established a Federal Facilities
Compliance Agreement with EPA to certify SPCC Plans at its facilities.
The Agreement established a schedule for complying with all aspects
of 40 CFR 112 at all Service facilities.
